Welcome to Zoofy. We want our terms to be clear, fair and easy to understand.

These Terms of Service explain the rules that apply when you visit zoofy.ie, use our online store or purchase products from us.

Nothing in these Terms limits or replaces any rights you have under Irish or European consumer law.

Zoofy is the retailer responsible for products purchased directly from zoofy.ie. Our online store is powered by Shopify, but your contract for the purchase of products is with Zoofy.

1. Using our website

You may use zoofy.ie to browse products, obtain information, create an account where available and purchase products from Zoofy.

You must use the website lawfully and must not deliberately interfere with its security, availability or operation.

If you are under 18, you should only place an order with the involvement and permission of a parent or legal guardian who is able to enter into the purchase contract.

2. Product information

We take reasonable care to make sure product descriptions, specifications, images, prices and availability information are accurate and useful.

Product packaging, colours or appearance may occasionally differ slightly from images shown online, particularly where a manufacturer changes packaging or where screen settings affect colour reproduction.

These differences do not affect your statutory rights. Products supplied by Zoofy must meet the requirements of applicable consumer law, including requirements relating to conformity, description and quality.

3. Product availability

Products are subject to availability.

Stock information displayed on zoofy.ie is intended to reflect our available inventory, but occasionally an item may become unavailable before an order can be fulfilled.

If we cannot supply an item you have paid for, we will contact you and provide an appropriate refund or other option agreed with you.

Some products may be marked as Order On Request. Where this applies, the product page will explain the applicable purchasing or fulfilment conditions before you place your order.

4. Prices and VAT

Prices displayed to consumers on zoofy.ie are shown in Euro (EUR) and include applicable VAT unless clearly stated otherwise.

Any delivery charge that applies to your order is shown separately before you complete checkout.

The total amount payable will be displayed before you submit your order.

Prices, promotions and discounts may change from time to time. Changes do not affect an order that we have already accepted.

If we discover an obvious pricing error before accepting or dispatching an order, we will contact you. You may choose whether to proceed at the correct price or cancel the affected item for a full refund.

5. Placing an order

When you submit an order through zoofy.ie, you are offering to purchase the products in your basket at the price and on the terms shown at checkout.

An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been accepted for fulfilment.

We may be unable to accept an order where, for example:

  • A product is unavailable
  • There is an obvious pricing or product information error
  • Payment cannot be authorised
  • We cannot deliver the product to the selected address
  • A product is subject to a legal, safety, animal welfare or delivery restriction
  • We reasonably suspect fraudulent or unlawful activity

If we cannot accept an order after payment has been taken, we will refund the relevant amount.

6. Payment

The payment methods currently available are shown at checkout.

You must provide accurate and complete billing and payment information and must be authorised to use the selected payment method.

Payments are processed using Shopify and/or the relevant payment provider. Zoofy does not require you to provide payment card details directly by email or social media.

7. Shipping and delivery

Our current delivery areas, delivery charges, free-shipping threshold, processing times and delivery information are set out in our Shipping Policy.

Our online checkout is currently configured for delivery within the Republic of Ireland.

Delivery times are estimates unless a specific delivery date has been agreed.

Zoofy remains responsible for goods while they are being delivered by a courier arranged by us. Responsibility for the goods passes to you when you, or a person you nominate, takes physical possession of the order.

If an order is lost, damaged or not delivered while in the care of a courier arranged by Zoofy, please contact us. We will deal with the issue in accordance with your consumer rights.

8. Click & Collect

Click & Collect is available from Zoofy Mallow for eligible products.

Please wait until you receive confirmation that your order is ready before travelling to collect it.

9. Returns, refunds and cancellation rights

Our return process, voluntary 30-day return period, statutory online cancellation rights, faulty-goods process and product-specific return restrictions are explained in our Refund Policy.

Eligible online purchases generally benefit from a statutory 14-day cooling-off period. Zoofy also provides an additional 30-day voluntary return period for eligible products, subject to the conditions in our Refund Policy.

Nothing in these Terms or our Refund Policy limits your statutory rights where goods are faulty, damaged, incorrect or not as described.

10. Restricted products and live animals

Certain products may have restrictions on delivery, collection, sale or return because of their nature, size, safety requirements, legal requirements or animal welfare considerations.

This can include live animals, live products, unusually large or heavy products and products marked as local-delivery-only or collection-only.

Where a restriction applies, we aim to make this clear on the product page and/or at checkout before purchase.

Any voluntary restrictions relating to live animals do not remove any statutory rights that apply to the purchase.

11. Pet food, treats and other consumable products

Pet food, treats, supplements and similar products should be stored and used according to their packaging and manufacturer instructions.

Some opened, unsealed, perishable or hygiene-sensitive products may have restrictions on change-of-mind returns. These are explained in our Refund Policy.

This does not affect your rights where a product is faulty, damaged, contaminated, incorrect or otherwise does not conform to the contract.

12. Subscriptions, pre-orders and special purchase options

Some products may be offered using a subscription, pre-order or other special purchase arrangement.

Where one of these options is available, the applicable price, billing frequency, delivery frequency and other important conditions will be shown before you agree to purchase.

If you purchase a subscription, you can manage or cancel it in accordance with the subscription terms presented when you subscribed and our applicable cancellation policy.

13. Promotions and discount codes

Promotions, discount codes and special offers may have additional conditions such as an expiry date, qualifying products, minimum spend or limits on combining promotions.

Any additional conditions will be provided with the relevant promotion.

Promotional terms do not affect your statutory consumer rights.

14. Gift cards

Zoofy gift cards, where available, may be used subject to the conditions shown when the gift card is purchased or issued.

Gift cards cannot normally be exchanged for cash except where required by law.

Any statutory rights that apply remain unaffected.

15. Reviews and customer content

If you submit a product review, photograph, comment or other content to Zoofy, you confirm that you have the right to submit that content and that it is not unlawful, misleading, abusive or infringing.

You grant Zoofy permission to display and use content you voluntarily submit in connection with operating and promoting Zoofy, subject to applicable law and our Privacy Policy.

We may moderate or remove content that is unlawful, fraudulent, abusive, irrelevant or otherwise breaches these Terms.

16. Search engines, AI assistants and shopping agents

Zoofy supports legitimate technologies that help customers discover, compare and understand our products.

Publicly available content on zoofy.ie may be accessed by legitimate search engines, AI assistants, shopping agents and similar automated services where access is permitted by our technical controls, robots directives and applicable law.

Automated services must not:

  • Circumvent security controls, CAPTCHAs, authentication or access restrictions
  • Ignore technical restrictions or applicable robot directives
  • Access customer accounts or non-public information without authorisation
  • Place an unreasonable or disruptive load on our systems
  • Use Zoofy content in an unlawful or misleading way

Third-party AI assistants and shopping agents are independent services. Zoofy cannot guarantee that information generated by a third-party service will always be current or accurate.

Customers should review the final product, price, availability, delivery information and order details presented by Zoofy before completing a purchase.

17. Prohibited use

You must not use zoofy.ie:

  • For unlawful, fraudulent or malicious purposes
  • To introduce malware, viruses or harmful code
  • To attempt unauthorised access to accounts, systems or data
  • To interfere with the security or operation of the website
  • To collect personal information about other people without lawful authority
  • To impersonate another person or provide deliberately false information
  • To infringe the intellectual property or other legal rights of Zoofy or a third party

18. Intellectual property

Unless otherwise stated, the Zoofy name, branding, original website content, graphics and other original materials are owned by or licensed to Zoofy and are protected by applicable intellectual property law.

Brand names, product images, trademarks and manufacturer materials belonging to third parties remain the property of their respective owners.

You may use our website for normal personal shopping and information purposes. Nothing in these Terms transfers ownership of Zoofy or third-party intellectual property to you.

19. Third-party services and links

Our website may use or link to services operated by third parties, including Shopify, payment providers, delivery providers, review platforms and social networks.

Those third parties may have their own terms and privacy policies.

Zoofy remains responsible for its own obligations to you as the retailer and does not use third-party providers to remove or reduce your statutory consumer rights.

20. Privacy and personal information

Information about how Zoofy collects and uses personal information is provided in our Privacy Policy.

Our online store is hosted by Shopify, which processes certain information required to provide the ecommerce platform and related services.

21. Website availability

We aim to keep zoofy.ie available and working correctly, but we cannot guarantee that the website will always be available without interruption.

We may occasionally need to maintain, update or secure the website.

Where a technical issue affects an order or payment, please contact us and we will work to resolve it.

22. Liability and your consumer rights

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

In particular, these Terms do not remove your rights in relation to goods that are faulty, damaged, unsafe, not as described or otherwise do not conform to your contract with Zoofy.

To the extent permitted by law, Zoofy is not responsible for losses caused by circumstances that were not reasonably foreseeable or that result from misuse of a product contrary to its instructions.

If you are purchasing as a consumer, nothing in these Terms is intended to exclude protections provided to you under applicable Irish or European consumer law.

23. Changes to these Terms

We may update these Terms when necessary to reflect changes to our business, website, services or legal obligations.

The Terms that apply to an order will generally be those in effect when you place that order, except where a change is required by law.

We will not use a later change to these Terms to remove statutory rights that applied to an existing purchase.

24. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be treated separately and the remaining Terms will continue to apply where legally possible.

25. Governing law

These Terms and purchases made directly from Zoofy are governed by the laws of the Republic of Ireland, subject to any mandatory consumer protections that apply.

Nothing in this section removes any right a consumer may have to bring a claim in a court or forum available to them under applicable law.
